• Outline application for the erection of one self-build dwelling on land lying to the north east of 15 East Hatley. The details are on the SCDC website.

• The consultation period ended on 13th July 2026 – all comments are normally taken into account right up to when the application is considered.

NB  This is an update to the original posting on 23rd June when the address on the application is given as ‘West of Moat Farm’.

Kim Wilde, clerk to Hatley Parish Council, queried the application with Heather Williams, our district councillor, because it is a close duplication of land described as ‘Land lying to the north east of 15 East Hatley’ in the application (25/02051/OUT) submitted in May 2025, which was refused on appeal.

Referring to section 70 of the Town and Country Planning Act, Kim was troubled how a development that had been refused by the Planning Inspectorate can be resubmitted so soon and with such small amendments.

To save time wasting, the Act states resubmissions that are ‘substantially the same’ can be denied if it is within two years of a refusal by the inspectorate.

The new application should have been denied, but was missed due to human error at SCDC (possibly understandable, with it being logged as Moat Farm).

• As the process is already under way it now must continue. SCDC understands residents / the parish council may want to just resubmit their previous response, with an updated planning reference number (which the parish council is doing).
